When is Larceny a Misdemeanor in NC?
Misdemeanor larceny under North Carolina General Statute 14-72(a) occurs when a person:
- takes away
- personal property (goods, chattel)
- that are in the possession of (or personal property of) another and
- who carries it away
- without the permission consent of the owner/possessor and (6) with the intent to permanently deprive the possessor of its use
- larceny in North Carolina is a “specific intent” crime. That means the person accused of criminal wrongdoing must know that he or she was not entitled to take the items at issue.
Personal property in North Carolina or “chattels” are different than “real property.” Real property involves land. Personal property is something different and may be money or goods or things of value other than real property.
Misdemeanor larceny is a class 1 misdemeanor with a maximum punishment under the law of 120 days incarceration and a discretionary fine not limited by the statute.
That makes it a serious criminal charge.
