Receiving Stolen Goods
In North Carolina, receiving stolen goods is divided into two separate categories: misdemeanor receiving stolen goods and felony receiving stolen goods.
Misdemeanor receiving stolen goods occurs when a person (1) receives or conceals (2) property (3) stolen by another (4) knowing, or with reasonable grounds to believe, that it was stolen and (5) with a dishonest purpose. Misdemeanor receiving stolen goods is a class 1 misdemeanor with a maximum punishment under the law of 120 days incarceration and a discretionary fine not limited by the statute.
Felony receiving stolen goods occurs when a person (1) receives or conceals (2) property (3) stolen or taken feloniously (4) by another (5) knowing, or with reasonable grounds to believe, that it was stolen and (6) with a dishonest purpose. Felony receiving stolen goods is a class H felony with a maximum punishment under the law of 39 months incarceration.
